CALL TO ORDER

Mayor Bruce Altznauer called to order the regular meeting of the Rutledge City Council on the above date. Council members Tony Sells, Brandie Owens and Adam Beckstine were present. Council member Brenda Thompson was absent. Members of the public and Morgan County Planner Tara Cooner were also present.

PLEDGE OF ALLEGIANCE

Mayor Altznauer called for and led the Pledge of Allegiance.

APPROVAL OF MINUTES – JANUARY 19, 2021

Council member Brandie Owens made motion to approve the minutes of the January 19,2021 meeting as submitted. Adam Beckstine seconded, all voted in favor and motion carried.

DISCUSSION OF SERVICE DELIVERY STRATEGY AGREEMENT AND RESOLUTION TO BE REVISED TO ADD SERVICE FACILITY – MADISON – MORGAN BOYS & GIRLS CLUB

Mayor Altznauer stated that a request was made to amend the SDS agreement to add Service Facility and Mike Conrad was present to talk about it. Mr. Conrads addressed the Council and stated the City of Madison is acting as the fiscal agent and paying for the grant writing services to apply for a CDBG grant application for $750,000.00. The grant is for a special service facility for the Morgan County Boys and Girls Club. He said we are not asking for money it will be funded by the Morgan County Boys & Girls Club and donor money to make this happen. We know there is a need to serve more kids in the outlying area. Council member Brandie Owens Made motion to approve the resolution to authorize the Mayor to execute the minor amendment to the Morgan County Service Delivery Strategy Agreement required by the Georgia Department of Community Affairs for cities and counties to apply and receive funding for the identified services and to amend to add the service Facility – Madison-Morgan County Boys & Girls Club.

Tony Sells seconded, all voted in favor and motion carried.

FIRE DEPARTMENT REQUEST – RUSS MCHUGH – PAVING

Council member Brandie Owens advised that Russ McHugh was not able to attend but she could to the issue he wanted to discuss. She said Russ McHugh was the chief of the Fire department and wanted to ask the Mayor and Council about paving at the Rutledge Fire Department in front of the bay doors since TSPLOST had passed. She stated that it was discussed with the county manager but was declined because the county does not own the building. Tony Sells asked what area were they wanting paved and Brandie said just in front of the bay area. Mayor Altznauer said it would really help the park area. He said he would get some quotes and bring it back before the Council.

BUSINESS LICENSE APPROVAL – SHANNON SENGSTACK – SOULSHINE MERCANTILE INC.

Mayor Altznauer stated the business license application submitted was a specialty retail shop and was located next to Rutledge Hardware at 118 Fairplay Street and is an allowed use. Tony Sells made motion to approve the business license application submitted by Shannon Sengstack for Soulshine Mercantile Inc. Adam Beckstine seconded, all voted in favor and motion carried.

Brandie Owens made motion to adjourn the regular meeting at 7:15 pm. Tony Sells seconded, all voted in favor and motion carried.

CALL TO ORDER PUBLIC HEARING

Mayor Altznauer called to order the Public Hearing for a proposed conditional use request by RAM Rutledge to operate a convenience store with fuel.

STAFF REPORT – MORGAN COUNTY PLANNER – TARA COONER

Tara Cooner stated that a conditional use application was submitted for 134 Atlanta Hwy. She said the ordinance allows a convenience store but the fuel sales causes a conditional use. RAM Rutledge wants to open with fuel sales. The canopy is partially on GDOT right of way. The applicant will need to provide documentation that GDOT has approved use of the location prior to the issuance of an occupational tax certificate. The applicant should provide letters from EPD as to whether an updated environmental study is required and from the Department of Agriculture to recertify the pumps. She advised that Chuck Jarrell had some issues with his drawings. The applicant has to get a building permit before the state agencies come out. He expressed a willingness to work with the Council provided he gets approval from GDOT and EPD. I ask that Council consider section 7.5 of the Rutledge Zoning ordinance. She said she spoke with City Attorney John Nix and we came up with a list of conditions. Tara Cooner read the list (List attached to minutes). Brandie Owens asked if the building was deemed sound. Tara Cooner advised that if a building is deemed unfit on condemned they must have a chance to fix it. The building is stable for him to do that. Brandie Owens said it will not open until Chuck Jarrell approves. Tara Cooner said he has to remodel and also get approval from GDOT, Department of Agriculture and EPD. Tara Cooner stated you can also add that the color needs to be compatible with the liquor store.

CONSIDERATION OF CONDITIONAL USE REQUEST BY CITY COUNCIL

Mayor Altznauer asked if everyone was in agreement with sending a letter with the conditions attached. Everyone agreed with letter stipulating the conditions.

Brandie Owens made motion to approve the conditional use request by Ram Rutledge to operate a convenience store with fuel with conditions outlined by Planning & Zoning to include the paint be compatible with the Rutledge Liquor Store. Tony Sells seconded, all voted in favor and motion carried.

Tony Sells made motion to adjourn at 7:35 pm. Adam Beckstine seconded, all voted in favor and motion carried.
